Terms and Conditions of Use
This is hi.buddy’s Terms and Conditions of Use (these “Terms”).
This application going to gather people together through spontaneous activities based on their artistic, cultural, social interests. This is an agreement between you and the Hi.buddy Group (as defined below), and we want you to know your rights and ours before using the Hi.buddy application of the (“Hi.buddy” or “Application”). Please take a few moments to read these Terms before enjoying the App, because once you access, view or use the App, you will be legally bound by these Terms (so it’s probably best to read them first!).
Hi.buddy will help you to organize sports events, cultural activities, artistic activities and social activities more widely in your province. For example, if you want to play table tennis but you don’t have an opponent, Hi.buddy will find it for you. Hi.buddy will be with you to plan the activity you want or reach according to your choices.
1. Hi.buddy RULES
Before using the application, you must open an account (“Account”). To create an Account: you are at least 18 years of age or of legal majority under the laws of your home country to enter into a contract; and have legal permission to use the App according to the laws of your own country.
You can create an Account via manual registration, or Facebook login details. If you create an Account using your Facebook login details, you authorise us to access, display and use certain information from your Facebook account (e.g. profile pictures, relationship status, location and information about Facebook friends). That’s necessary for the development of our app. For more information about what information we use and how we use it, please check out our Privacy Policy.
Unfortunately, we cannot allow you to use another person’s Account or share your Account with another person without permission.
You will have a lot of fun on Hi.buddy, but if you feel the need to leave, you can delete your Account at any time by going to the ‘Settings’ page when you are logged in and clicking the ‘Delete account’ link. Your account will be deleted immediately, but it may take some time before your Content (defined below) is completely removed from the App. Your profile information will be processed in accordance with our Privacy Policy.
We use a combination of automated systems and a team of moderators to monitor and review accounts and messages for content that indicates a violation of these Terms. We reserve the right, in our sole discretion, to terminate or suspend any Account, restrict access to the App, or use any available operational, technological, legal or other means (including but not limited to blocking certain IP addresses) to enforce the Terms. at any time without any liability and without the need to give you advance notice. Without limiting in any way the foregoing, we expressly reserve the right to terminate or suspend your Account without notice for violating these terms due to your behavior on the App or your behavior with other users of the App (including your “offline” behavior). ), if we or our affiliates determine, in our sole discretion, that your conduct in other applications operated by our affiliates is inappropriate or inappropriate, or if for any reason we determine in our sole discretion, termination is justified. everything we think is. 2. TYPES OF CONTENT

As Your Content is unique, you are responsible and liable for Your Content and will indemnify, defend, release, and hold us harmless from any claims made in connection with Your Content.Therefore, NEVER forget that you are interacting with real people.
You may not display any personal contact or banking information about you or any other person on your personal profile page (for example, names, home addresses or zip codes, phone numbers, email addresses, URLs, credit/debit card or other banking transactions details). If you choose to disclose any personal information about yourself to other users by email or otherwise, it is at your own risk. We recommend that you exercise the same care when disclosing details about yourself online to third parties as you would under other circumstances.
As Hi.buddy is a public community, your Content will be instantly visible to other App-based users in Turkey and around the world – so make sure you are comfortable sharing your content before joining the activity or the message group or that it can be viewed by anyone who has posted a link to the App (for example, people who receive a link to a user’s profile or share content from other Hi.buddy Users). By uploading your Content to Hi.buddy, you represent and warrant that you have all necessary rights and licenses to do so and that you automatically grant us a non-exclusive, royalty-free, perpetual, worldwide license to use your Content in any way. (including, without limitation, editing, copying, modifying, adapting, translating, reformatting, creating derivative works from, incorporating, advertising, distributing and otherwise making all or part of such Content and otherwise publicly available) any format or medium that is currently known or will be developed in the future).
We may transfer and/or sublicense the above license to our affiliates and successors without further approval by you.
We have no obligation to keep your content – you should make a copy if it’s important.
Content of Other Members
Hi.buddy’s Other Members’ Content will also share content through the App. Member Content belongs to the user who participates in a social meeting of the content or creates the content and is stored on our servers and viewed through the Application at the instruction of the user providing the Member Content.
You have no rights to use other users’ Member Content and may use other Hi.buddy users’ personal information only to the extent that your use is consistent with Hi.buddy’s purpose of allowing people to meet each other. You may not use other users’ information for commercial purposes, to spam, harass, stalk, or make unlawful threats. We reserve the right to terminate your Account if you misuse other users’ information.
Member Content is subject to the terms and conditions of Turkish Civil Code no 4721 and Turkish Personal Data Protection Law no. 6698 If you have a complaint about Member Content, please see the Turkish Personal Data Protection Law and Turkish Civil Code no 4721 section below for more information.
Other Content as a any other text, content, graphics, user interfaces, trademarks, logos, sounds, artwork, images, and other intellectual property appearing on our Services is owned, controlled or licensed by us and protected by copyright with Turkish Industrial Property Act Law No:6769, trademark and other intellectual property law rights. All industrial property rights, title, and interest in and to Our Content remains with us at all times.
3. RESTRICTIONS ON APPLICATION
By using our services, you represent and warrant that:
You are at least 18 years old;
You are authorized to enter into a legally binding contract with Hi.buddy;
You are not prohibited by law from using our Services;
You have not been convicted of a felony or a prosecutable offense (or a crime of similar severity), a sex offense or any violent crime, or entered any competition;
If you do not have more than one account on our Services; and
You have not been previously removed from our Services by us unless we have our express written consent to create a new account.
If you stop meeting these requirements at any time, you must delete your account immediately.
You agree to:
Comply with these Terms and check this page from time to time to ensure you are aware of any changes;
Comply with all applicable laws, including but not limited to privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements;
Use the latest version of the application;
Treating other users in and out of our Services in a courteous and respectful manner;
Be respectful when communicating with any of our members;

Maintain a strong password and take reasonable precautions to keep your login information secure.
You agree that you will not:
Misrepresent your identity, age, current or previous positions, qualifications, or affiliations with a person or organization;
Use the Services in a way that harms the Services or prevents them from being used by other users;
Use our Services in a way that interferes with, disrupts or adversely affects the platform, servers or networks of our Services;
Use our Services for any harmful, illegal or nefarious purpose;
Harass, bully, stalk, intimidate, attack, defame, harm or otherwise mistreat any person;
Post or share Banned Content (see below);
Asking other users for passwords for any purpose or personally identifiable information for commercial or illegal purposes, or disseminating another person’s personal information without their or other gender consent;
Request money or other items of value in the form of gifts, loans or compensation from another user;
Use another user’s account;
Violating the terms of the license granted to you by Hi.buddy
Disclose proprietary or proprietary information that you do not have the right to disclose;

Modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise decompile any part of our Services or cause others to do so;
use or improve any third-party application that interacts with our Services or Member Content or information without our written consent;
use, access or publish the Hi.buddy application programming interface without our written permission;
To investigate, scan or test the vulnerability of our Services or any system or network; or
Encourage, promote or agree to engage in any activity that violates these Terms.
Prohibited Content—Hi.buddy prohibits uploading or sharing content that:
Likely to be considered offensive or to harass, upset, embarrass, alarm or annoy another person;
Obscene, pornographic, violent or otherwise defamatory or nude;
Harassing, insulting or threatening, discriminatory or promoting or promoting racism, sexism, hatred or bigotry;
Promotes or facilitates terrorism, any illegal activity whose incitement or presentation of racial hatred is in itself a crime;
Defamatory, or untrue;
Contains “junk” mail or “spam” transmission; spyware, adware, virus, corrupted file, worm program or program designed to interrupt, damage or limit or disrupt the functionality of any software, hardware, telecommunications, networks, servers or other equipment, Trojan horse or any other designed material; or contains other malicious code. damage, interfere with, falsely intercept or expropriate any data or personal information from Hi.buddy or otherwise;

A picture or image that contains a picture or likeness of another person (or, if a minor, the parent or guardian of the minor) without that person’s consent, or is not accompanied by the minor’s parent or guardian, or a minor child;
Is inconsistent with the intended use of the Services;
May harm the reputation of Hi.buddy or its affiliates.
The uploading or sharing of content that violates these terms (“Prohibited Content”) may result in the immediate suspension or termination of your account.
We don’t like users misbehaving in the Hi.buddy community. You may report any abuse or complaint regarding Member Content by outlining the abuse and/or complaint by contacting us. You can also report a user or event from a profile or chat or event page by clicking the “Report” buttons in the app. We reserve the right to investigate possible violations of these Terms and may, at our sole discretion, immediately terminate any user’s right to use the App, as further detailed in Section 1 above, without notice.
We do not control anything our users say or do, so you are solely responsible for your interactions with other users of the App.
You agree and hereby agree to indemnify Hi.buddy Group and its successors from any and all claims, demands, losses, damages, rights and actions, whether directly or indirectly, including personal injury, death and property damage. Your interactions or behavior with other users of the app.
4. PRIVACY
For information about how the Hi.buddy Group collects, uses, and shares your personal data, please check out our Privacy Policy. By using Hi.buddy, you acknowledge that we may use such data in accordance with our Privacy Policy.
5. PUSH NOTIFICATIONS; LOCATION-BASED FEATURES
We may provide emails, text messages, push notifications, alerts and other messages such as improvements, offers, products, events and other promotions related to the App of Hi.buddy services. After downloading the app, you will be asked to accept or decline push notifications/alerts. If you decline, you will not receive any push notifications/alerts. If you accept, push notifications/alerts will be sent to you automatically. If you no longer want to receive push notifications/alerts from the App, you can disable it by changing your notification settings on your mobile device.
Depending on your location, the App may allow access or offer opportunities for you to view certain content and receive other products, services and/or other materials. To provide you with these opportunities, the Application will determine your location using one or more reference points such as GPS, Bluetooth and/or software on your mobile device. If you have set your mobile device to disable GPS, Bluetooth or other geolocation software, or have not given permission for the App to access your location data, you will not be able to access such location-specific content, products, services and materials. 6. DISCLAIMER
The App, our content, and all member content are provided to you “as is” and “as available”, without warranties of any kind, either express or implied, including, but not limited to, fitness for a particular purpose, title, or violation. Without limiting the above, we do not guarantee the compatibility of any activity match.
If applicable law does not allow the exclusion of the express or implied warranties set forth above, we make the minimum express or implied warranty required by applicable law. No oral or written advice or information creates any warranty, representation or warranty not expressly stated in this section.
In addition, the application or site will be uninterrupted, secure or error-free, or that your use of the application will meet your expectations, or that the application, our content, member content, or any part thereof, is accurate, accurate or reliable. Your use of the application or site is at your own risk. You are solely responsible for your interactions with other members. Hi.buddy group is not responsible for the behavior of any user. The Hi.buddy group does not conduct criminal background checks on its members.
7. LIMITATION OF LIABILITY
Neither We nor Any Owner shall be Liable for Direct, Indirect, Incidental, Consequential, Special or Punitive Damages, including, without limitation, Loss of Data, Income, Profit or Goodwill, Loss or Damage to Property, and Third Claims. Parties Caused by Your Access to or Use of the App, Site, Our Content, or Any Member Content, Breach of Contract, Tort (including negligence), Violation of Property Rights, Product Liability, or Otherwise.
The above will apply even if we are advised of the possibility of such damages. If You Are In Any Way Dissatisfied with the Application or the Site, Your Sole and Exclusive Remedy is to Discontinue Your Use of the Application and Site.
You Waive All Claims That May Arise From Your Use of the Application or Site. These Terms May Not Apply to You, as Some States Do Not Allow the Disclaimer of Implied Warranties or the Exclusion or Limitation of Certain Types of Damage. This Limitation of Liability is an Essential Element of the Basis of Bargaining and Reflects a Fair Distribution of Risk. The Application and the Site shall not be Provided Without Such Limitations, and You Agree that the Limitations and Exemptions of Liability, Disclaimer and Exclusive Remedies Set forth Herein Will Be Applied Even If They Are Found to Failing Their Essential Purposes. The Above Does Not Apply to Liability for Fraud or Fraudulent Misrepresentations, or Other Liability Not Limited by Applicable Laws.
8. COMPENSATION
All actions you take and the information you post on Hi.buddy are your responsibility. Therefore, we and our partners, licensors, affiliates, contractors, officers, directors, employees, agents, and agents are liable to any third party claim, harm (actual and/or consequent, or in connection with, acts, actions to which we are or reasonably incurred). , claims, losses, liabilities, costs and expenses (including reasonable legal fees):
any negligent act, neglect or willful misconduct by you;

We reserve the exclusive right to conciliate, settle and pay any claim or cause of action brought against us without your prior consent. If we ask, you will cooperate fully and reasonably as we request in the defense of any related claim.
The foregoing does not indemnify Hi.buddy Group for any unreasonable commercial practice or any fraud, deception, false promise, misrepresentation or concealment, concealment or omission of any material fact in connection with the Application.
9. THIRD PARTY APP STORE
If you download the App from a Third Party Store, the following additional terms and conditions apply to you. To the extent other terms and conditions of these Terms are less restrictive or otherwise conflict with the terms and conditions of this Section, the more restrictive or conflicting terms and conditions in this Section will apply only to the App and the Third Party Store.
You acknowledge and agree that:
These Terms are entered into between you and the Hi.buddy Group, and not with the providers of the Third Party Store, and the Hi.buddy Group (not the Third Party Store providers) is solely responsible for the Application and its content. To the extent that these Terms provide terms of use for the App that are less restrictive or conflict with the applicable terms of service of the Third Party Store from which you obtained the App, the more restrictive or conflicting term of the Third Party Store prevails and will prevail.
The Third Party Store provider has no obligation to provide any maintenance and support services with respect to the Application. Hi.buddy Group is solely responsible for any product warranty, express or implied by law, to the extent that it is not effectively disclaimed. The Third Party Store provider will have no warranty liability with respect to the App and any other claims, losses, liabilities, damages, costs or expenses arising from non-compliance with any warranty shall be the sole responsibility of Hi.buddy. Group.
The Hi.buddy Group, and not the Third Party Store provider, is responsible for handling any claim by you or any third party regarding the Application or your possession of the Application and/or the Application, including but not limited to: (i) product liability claims; (ii) any claim that the App does not comply with any applicable legal or regulatory requirements; (iii) claims arising from consumer protection or similar legislation; and/or (iv) claims of intellectual property infringement.
The Third Party Store provider and its affiliates are third party beneficiaries of these Terms and upon your acceptance of these Terms, the Third Party Store provider from which you obtained the Application will be entitled (and will be deemed to have accepted such right). ) to enforce these Terms against you as a third party beneficiary.
In the event of a conflict between the applicable terms and conditions of a Third Party Store or mobile operator and these Terms, the Third Party Store or mobile operator’s terms and conditions will govern. We are not responsible and have no liability for third party goods or services that you obtain through the Third Party Store or mobile operator. We encourage you to do any research you consider necessary or appropriate before taking any online transaction with any of these third parties.
10. TERMINATION AND REMEDIES
These Terms begin on the date you accept them (as originally described) and continue until terminated in accordance with the terms herein.
If you wish to terminate these Terms, you may do so at any time by (a) notifying the Hi.buddy Group and (b) closing or deleting your Account. Your notification should be sent to the following address of Hi.buddy Group. Hi.buddy Group may terminate or suspend these Terms, including your Account, if you violate these Terms or if Hi.buddy Group is required to do so by applicable law. You agree that all terminations for cause will be made at the sole discretion of Hi.buddy Group and that Hi.buddy Group will not be liable to you or any third party for any termination of your Account.
In the event that Hi.buddy Group determines, in its sole discretion, that you have breached any portion of these Terms, or have otherwise demonstrated conducted inappropriate for the App, Hi.buddy Group reserves the right to: (a) warn you via email (to any email addresses you have provided to Hi.buddy Group) that you have violated the Terms; (b) delete your User Content; (c) discontinue your Account; (d) discontinue your subscription(s); (e) notify and/or send your User Content to and/or fully cooperate with the proper law enforcement authorities for further action; and/or (f) pursue to any other action which Hi.buddy Group deems to be appropriate.
Termination of these Terms or your Account includes removal of access to your Account and all related information and content associated with or within your Account.
11. MISCELLANEOUS
There are a few more things we should mention before using Hi.buddy.
These Terms, which we may change from time to time, constitute the entire agreement between you and the Hi.buddy Group. The Terms supersede all prior agreements, representations and regulations between us, with the exception of the Privacy Policy. Nothing in this clause limits or excludes any liability for fraudulent misrepresentation.
The Hi.buddy Group has taken reasonable steps to ensure the timeliness, availability, accuracy and completeness of the information contained on Hi.buddy and provides such information “as is” and “as available”. The Hi.buddy Group makes no warranties, representations or representations of any kind, express or implied, regarding the information contained in Hi.buddy. The use of Hi.buddy and the materials on it is entirely your own. Hi.buddy Group is not responsible for any loss resulting from the transmission, use of data or incorrect Member Content.
You are responsible for taking all necessary precautions to ensure that any material you may obtain from Hi.buddy is free of viruses or other harmful components. You agree that Hi.buddy will not be provided uninterrupted or error-free, defects cannot be fixed, or that the Hi.buddy Group or the server that makes it available is free of viruses or bugs, spyware, Trojan horses or any other virus. similar malware. Communication between you and Hi.buddy Group may be done electronically, whether you use the App or send Hi.buddy Group emails, or whether Hi.buddy Group posts notices on the App or communicates with you via email. For contractual purposes, you agree to (a) receive communications from Hi.buddy Group in electronic form; and (b) you agree that all terms and conditions, agreements, notices, disclosures and other communications that Hi.buddy Group provides to you will be fulfilled electronically if in writing.
12. GOVERNING LAW AND FORUM
Your access to the App, our Content and any Member Content, any claims arising out of or relating to your relationship with the Hi.buddy Group, and these Terms are governed and construed by the laws of the State of Turkey. Ankara courts are authorized for any lawsuit to be filed against Hi.buddy. You agree that you will not bring or participate in a class action lawsuit against us.
